The Quintana Roo Electoral Tribunal (Teqroo) has unanimously confirmed the validity of the recent elections in the municipalities of Benito Juárez and Cozumel. This confirmation also endorses the delivery of majority certificates to the candidates for municipal presidencies in both areas, who were nominated by the Morena-PVEM-PT coalition.
In the Benito Juárez election, the tribunal unanimously confirmed the renewal of the municipality's leadership. The majority certificates were awarded to the ballot led by Ana Patricia Peralta de la Peña, the new municipal president. This decision resolves Nullity Trial JUN/008/20240, which was brought forth by the Party of the Democratic Revolution (PRD).
Teqroo dismissed the PRD's grievances, stating that the party's claims of exceeding campaign spending limits were unfounded. The tribunal's decision was based on a review of income and campaign expense reports from the National Institute of the INE's Technical Unit of Fiscalization. The review found that the elected candidate's expenses were below the approved limit set by the General Council of the Electoral Institute of Quintana Roo (Ieqroo).
The tribunal also dismissed the PRD's claims of illicit or public resource use in the campaign. The party's sole evidence was a series of complaints filed with the IEQROO and the INE's Technical Unit of Fiscalization, which the tribunal ruled were insufficient to support the accusations.
In the Cozumel municipality election, the Institutional Revolutionary Party (PRI) and National Action Party (PAN) filed Nullity Trials JUN/007/2024 and JUN/09/2024. These trials sought to nullify the votes received at the ballot box, claiming violations of sections IV, X, and XIII of article 82 of the Law of Means of Challenge in Electoral Matters for the State of Quintana Roo. The parties also argued that the election should be nullified due to violations of constitutional principles including legality, equity, equality, certainty, independence, impartiality, and neutrality.
The tribunal decided to uphold the ballot boxes denounced by sections IV, X and XIII, excluding ballot box 200 contiguous 4 due to the official not belonging to that section. The final rearrangement did not significantly alter the result that benefited the winning list. The tribunal also declared the other grievances unsubstantiated, as the documents provided did not prove that the causes of nullity referred to were valid.
